Terms of Service

These Terms of Service ("Terms") govern your use of the Vesper suite of accessibility tools and the vesperapps.com website, operated by Vesper Technologies LLC ("Vesper", "we", "us", or "our"), an Oregon limited liability company. By downloading, installing, or using any Vesper product, you agree to these Terms.
1. Products and availability
The Vesper suite currently includes Vesper Colors (iOS app and web tool), Vesper Inspect (Chrome extension), Vesper Audit (macOS desktop app), and Vesper Guides (web). We reserve the right to modify, suspend, or discontinue any product or feature at any time without notice.
2. Free products
Vesper Colors, Vesper Inspect, and Vesper Guides are provided free of charge with no account required. They are provided "as is" without warranty of any kind.
3. Vesper Audit - paid licenses
Vesper Audit is available in a free tier and a paid Supporter tier. Supporter licenses are sold through a third-party payment processor. By becoming a supporter you also agree to the payment processor's terms of service.
License scope. A Supporter license grants you a personal, non-transferable, non-sublicensable right to use the Supporter-tier features of Vesper Audit on the number of devices specified at purchase.
Refund policy. Refund requests may be submitted within 14 days of purchase via our contact page. We will honour reasonable refund requests within that window at our discretion. After 14 days, all sales are final.
No refunds on business dissolution. If Vesper Technologies LLC ceases operations, dissolves, or otherwise permanently discontinues business for any reason, no refunds will be issued for any previously purchased licenses, regardless of when the license was purchased, how recently it was purchased, or how much of the license term remains. By purchasing a license, you acknowledge and accept this risk. Your license key will continue to function in any version of Vesper Audit released prior to dissolution, but no further updates, support, or activations will be available.
No transfer. Licenses may not be resold, transferred, or sublicensed.
4. Acceptable use
You agree not to use any Vesper product to violate applicable law, infringe any third party's rights, or interfere with the operation of the Services. You agree not to attempt to reverse engineer, decompile, or extract source code from any Vesper product.
5. Intellectual property
All Vesper products, including their code, design, wordmarks, and documentation, are owned by Vesper Technologies LLC. Nothing in these Terms transfers any ownership to you. The Vesper name, logo, and product wordmarks may not be used without written permission.
6. Disclaimer of warranties
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be error-free or uninterrupted.
7. Limitation of liability
To the maximum extent permitted by law, Vesper Technologies LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, even if advised of the possibility of such damages. Our total liability for any claim arising from the Services shall not exceed the amount you paid us in the 12 months preceding the claim.
8. Governing law
These Terms are governed by the laws of the State of Oregon, United States, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Oregon.
9. Changes to these Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
